True Cost of a Housing Disrepair Claim: Benchmarks That Actually Matter
Most CMCs have no idea what a housing disrepair claim actually costs to run from intake to settlement. Without accurate benchmarks, you cannot price risk or spot profitable cases.

I have seen CMCs quote intake costs anywhere from £150 to £800 per case with no rational basis for either figure. The truth is that benchmark costs depend entirely on how you structure your operation and at what stage you filter claims. Get this wrong and you bleed money on cases that should never have left the intake queue.
Start with the Pre-Action Protocol for Housing Conditions Claims England. Compliance is not optional. A properly prepared letter of claim requires surveyor instruction, medical evidence where relevant, and disclosure requests. The surveyor alone will cost you between £300 and £600 depending on property size and location. Add administrative time for chasing local authority repairs logs under section 11 of the Landlord and Tenant Act 1985 and you are looking at six to ten hours of paralegal time before a solicitor even reviews the file.
The case of Birmingham City Council v Lee 2008 EWCA Civ 891 remains instructive on proportionality. Courts will not award costs that exceed the value of the claim without good reason. If your average settlement sits around £3,000 to £5,000, your total disbursement and work-in-progress exposure needs to stay well under half that figure or you are working for free.
My benchmark for a straightforward HDR claim from intake to settlement runs between £1,200 and £1,800 in actual cost including disbursements. That assumes efficient triage at intake, digital document handling, and panel solicitors who do not gold-plate files. If your numbers are higher, your process is broken.
Track every cost element separately. Surveyor fees, medical reports, counsel where instructed, court fees if litigation becomes necessary. When you know your true cost per claim type you can finally make intelligent decisions about which cases to pursue and which to decline at the door.
